When a person’s body contains a specified controlled drug and that person drives or attempts to drive, or is in charge of a motor vehicle, they are guilty of an offence if the proportion of the drug in their body exceeds the allowable limits of that drug, regardless of any potential effects it may have on their ability to drive.

Drugs affected by the regulations are:

  • Benzoylecgonine
  • Clonazepam
  • Cocaine
  • Delta-9-tetrahydrocannabinol
  • Diazepam
  • Flunitrazepam
  • Ketamine
  • Lorazepam
  • Lysergic acid diethylamide
  • Methadone
  • Methylamphetamine
  • Methylenedioxymethamphetamine
  • 6-monoacetylmorphine
  • Morphine
  • Oxazepam
  • Temazepam.
